Please read these Official Rules carefully before entering the Cricut Ticket Contest.  By entering the Cricut Ticket Contest, you agree that you have read, and are bound by, the terms and conditions set forth below as if you had actually signed them.  If you do not agree to the terms and conditions set forth below, you may not participate in the Cricut Ticket Contest.  By entering the Cricut Ticket Contest, you acknowledge and agree that these Official Rules are a legally binding contract between you and the Sponsor as defined below.  The Sponsor may modify the terms and conditions of these Official Rules as described below, and you agree to familiarize yourself with any modifications.

  1. Void Where Prohibited or Restricted by Law.  All federal, state, and local regulations apply to the Cricut Ticket Contest (“Contest”).  The Contest is void in any jurisdiction where it is prohibited by law or regulation.
  2. Eligibility: The Contest is only open to legal residents of the United States and Canada, who are residing therein, and who are 18 years of age or older as of the time of entry.  Employees, officers, and directors of Provo Craft & Novelty, Inc. (collectively the “Sponsor” and/or the “Contest Administrator”); Holland America Cruise Lines; each of the foregoing entities’ affiliates and advertising and promotion agencies; Sponsor-authorized designees associated with the design, administration, and/or fulfilment of the Contest (collectively “Contest Entities”); and members of the immediate families of such persons (spouses, children, siblings, parents, and/or persons living in the same household as such persons, whether or not related) are ineligible to enter the Contest.
  3. Contest Description: Beginning at 12:00:00 a.m. Eastern Time (“ET”) on July 1, 2009, and ending at 11:59 p.m. ET on August 15, 2009 (“Contest Period”) (or while supplies last, which ever comes first) randomly packaged boxes of Cricut Jubilee, Simply Sweet, Home Décor, and Stand and Salute cartridges packaged by Provo Craft & Novelty, Inc. will contain valid “Grand Prize Winner” certificates (“Ticket”).  Additionally, during the contest period, the Sponsor will establish a pool of blank and winning certificates.  Persons who enter through the mail-in process specified in these rules will be entered into a drawing of equivalent odds.  Eligible Winners of the drawing will be mailed a Winning Ticket and will be awarded a Grand Prize as specified in these rules. 
  4. How to Enter: No purchase of any product is necessary to enter or win the Contest. All eligible persons who purchase an above listed Cricut cartridge are automatically entered to win.  Person’s wishing to enter the Contest without purchasing a Cricut Cartridge may enter once a week during the Contest Period by sending a self-addressed, stamped envelope to:  Provo Craft Cricut Ticket Contest Entry, Provo Craft & Novelty, Inc., 151 East 3450 North, Spanish Fork, Utah 84660.
  5. Prizes/Odds of Winning: Twenty (20) Grand Prizes will be awarded in the Contest. Grand Prize winners will receive a seven- (7) day cruise for two (2) persons to the Caribbean (“Grand Prize”).  The Grand Prize includes $600 to be applied to airfare and hotel expenses.  Odds of winning the Grand Prize depend on the total number of eligible Contest Entries received during the Contest Period.  The odds of winning are presently estimated to be approximately 1 in 13,500.
  6. How to Claim a Grand Prize: In order to be accepted, Grand Prize winners must claim their prize by calling the telephone number listed on the winning ticket.  Winners will also be directed to enter a code at www.cricut.com/cricutticket. Original tickets must be postmarked and mailed to Provo Craft for verification by 11:59 p.m. on August 15, 2009.  Provo Craft recommends you make a photocopy of the front and back of your ticket before mailing.  Putative Grand Prize claims must be sent at the expense of the putative Grand Prize Winner, for Sponsor verification, to: Provo Craft Cricut Ticket Contest Verification Officer, Provo Craft & Novelty, Inc,. 151 East 3450 North, Spanish Fork, Utah 84660. A putative Grand Prize claim must include the putative Grand Prize Ticket and the name, address, telephone number, and if available, email address of the putative Grand Prize Winner.    Verification of prizes will occur within 6-8 weeks from the date of receipt by the Sponsor or as soon after such period as is reasonably possible to verify the validity of the Grand Prize.  Sponsor will contact a putative winner at the address and/or telephone number and/or email address provided with the verification request.
  7. Affidavit of Eligibility/Release:  A putative Grand Prize winner may be required to execute and return a notarized Affidavit of Eligibility/Release of Liability and (except where prohibited) Publicity Release form within ten (10) business days of the date of issuance of such documents.  Where the putative Grand Prize winner is a minor in the jurisdiction where he/she resides, the parent or legal guardian must provide written consent on such forms. Putative Grand Prize winner’s failure to return all completed and required forms in this ten (10) business day time period may result in the potential Grand Prize winner being disqualified and an alternate Grand Prize winner may be selected at Sponsor’s sole discretion. If any delivery of the Affidavit of Eligibility/Release of Liability and Publicity Release forms or Grand Prize is returned as undeliverable for any reason, the potential Grand Prize winner shall be disqualified and the Ticket held by such putative Grand Prize Winner shall be declared void.  If Grand Prize winner is a resident of a jurisdiction that deems him/her to be a minor, his/her Grand Prize will be awarded in the name of his/her parent/legal guardian.      
  8. Grand Prize Winner Eligibility/Payment of Taxes and other Fees/Loss or Substitution of Grand Prize:  A Grand Prize winner must be eighteen (18) years of age or older.  In the event the Grand Prize winner is a resident of a jurisdiction that deems him/her to be a minor even through he/she is eighteen (18) years of age or older, the Grand Prize must be accepted by his/her parent or legal guardian.  Any costs associated with accepting or redeeming the Grand Prize, which are not specifically mentioned herein as being included, are the sole responsibility of the winner including any unspecified state or local taxes or government surcharges or fees and expenses. Sponsor or its designee will not replace the Grand Prize if lost or stolen once the Grand Prize is in the possession of the Grand Prize winner. Any unclaimed and/or unused Grand Prizes will be forfeited by the Grand Prize winner and will remain the property of Sponsor.  Terms and conditions subject to change without notice.  Sponsor will not permit substitution, transfer, or payment of a cash equivalent for the Grand Prize, except that Sponsor, at its sole discretion, may substitute the Grand Prize with a prize of equal or greater value, whether due to the unavailability of Grand Prize or for any other reason. Any depictions of Grand Prize are for illustrative purposes only. All federal, state, or other taxes (if applicable) including, without limitation, income taxes, are the sole responsibility of winner. Grand Prize winner may receive an IRS form 1099 from the Contest Administrator for the total amount of the Grand Prize for the calendar year the Grand Prize was won.
  9. General Conditions: The Contest is subject to modification, cancellation, or limitation at the Sponsor’s discretion, with or without notice.  The Contest is subject to these Official Rules and all federal, state and local laws and regulations (collectively “Rules and Laws”). Except where prohibited by law, winner’s entry and/or acceptance of the Grand Prize constitutes permission of winner (or, if a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal guardian) for Contest Entities to use, without notice or further compensation, worldwide and in perpetuity in any and all forms of media, now known and hereafter devised, such winner’s name, likeness, pictures, photographs, voice, biographical information, and statements for purposes of advertising, trade, promotion, and publicity.  Sponsor reserves the right in its sole discretion to not award the Grand Prize (or any portion thereof) to any person it reasonably suspects of tampering with a putative Ticket.  Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be in violation of the Official Rules. Any person attempting to defraud any of the Contest Entities or in any way tamper with the Contest will be ineligible to win the Grand Prize and Sponsor will seek all remedies available to it including, if appropriate, filing appropriate civil, criminal, and/or administrative complaints with legal authorities.
  10. Limitation of Liability: Contest Entities, Sponsors, and/or Contest Administrator, and their attorneys, including outside attorneys are not responsible or liable for Entries that are illegible, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered, or otherwise not in compliance with these Official Rules, whether caused by Sponsor or the Entrant. By entering the Contest, each entrant (or his/her parent/legal guardian if the entrant is a minor in the jurisdiction he/she resides) irrevocably agrees and acknowledges to be bound by the Official Rules and all applicable laws and decisions of the Sponsor which are final and binding in all respects; to forever and irrevocably waive all of his/her rights to claim ambiguity with respect to the Official Rules and to waive all of his/her rights to bring any claim, action, or proceeding against any of the Contest Entities, the Sponsor, and/or Contest Administrator in connection with the Contest; and to forever and irrevocably release, indemnify, and hold harmless each of the Contest Entities, Sponsor and/or Contest Administrator, and their respective officers, directors, employees, or agents including outside attorneys, shareholders, representatives, successors, and assigns (collectively the “Releasees”) from any liability (including, but not limited to, liability for defamation, libel, slander, invasion of privacy, infringement of publicity or any intellectual property rights, any property loss, damage, personal injury, bodily injury, death, expense, accident, delay, inconvenience or irregularity, and any indirect, incidental, consequential, special, punitive or exemplary damages of any kind even if the Releasees have been advised of the possibility of such loss or damages), costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise from, result from, or are in connection with: (a) the Contest including, but not limited to, any Contest-related activity or element thereof and the entrant’s entry, participation, or inability to participate in the Contest; (b) the violation of any privacy, personal, publicity or proprietary rights; (c) typographical errors in these Official Rules or any Contest promotional materials; (d) acceptance, attendance at, participation in, possession, defects in, use, misuse, or inability to use the Grand Prize (or any component thereof); (e) any change in the prizing (or any components thereof) due to unavailability, business or creative considerations, or due to reasons beyond Sponsor’s control including, but not limited to, by reason of any acts of God, any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not such action(s), regulation(s), order(s), or request(s) prove(s) to be invalid), equipment failure, threatened or actual terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond any of the Contest Entities’ control, or as otherwise permitted in these Official Rules; (f) any interruptions in or postponement, cancellation, or modification of the Contest; (g) human error; (h) incorrect or inaccurate transcription, receipt, or transmission of any part of the Contest Entry (including, without limitation, the Contest Entry information or any parts thereof); (i) any system, computer timing and/or dating mechanism, computer equipment, software, or Internet service provider utilized by any of the Contest Entities or by an entrant; (j) interruption or inability to access the Contest, the Website, or any other Contest-related web pages or any online service via the Internet due to hardware or software compatibility problems; (k) any damage to entrant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Contest; (l) any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other destroyed, incomplete, undeliverable or damaged Contest Entries; (n) any wrongful, negligent, or unauthorized act or omission on the part of any of the Contest Entities, or any of their agents or employees; (o) cancellations, delays, diversions, or substitutions or any act or omissions whatsoever by the air carrier(s) or other transportation companies, hotel(s), or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same; (p) lost, stolen, damaged, delayed, or misdirected baggage; or (q) lost, late, stolen, misdirected, damaged, or destroyed prizing (or any element thereof). Each entrant (and his/her parent/legal guardian if the entrant is a minor in the jurisdiction he/she resides) hereby acknowledges that the Contest Entities have neither made nor are in any manner responsible or liable for any express or implied warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Grand Prize or any component thereof.
  11. Interpretation of Official Rules.  All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules of the Sweepstake or the rights and obligations of the Sponsor in connection with the Sweepstake shall be governed by, and construed pursuant to, the sole discretion of the Sponsor.
  12. ARBITRATION; WAIVER OF INJUNCTIVE RELIEF; GOVERNING LAW: BY ENTERING THE CONTEST, EACH ENTRANT (AND HIS/HER PARENT/LEGAL GUARDIAN IF THE ENTRANT IS 18 YEARS OF AGE OR OLDER BUT LEGALLY REMAINS A MINOR IN THE JURISDICTION HE/SHE RESIDES) AGREES THAT ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES, THEIR ENFORCEMENT, ARBITRABILITY, OR INTERPRETATION SHALL BE SUBMITTED TO FINAL AND BINDING ARBITRATION, TO BE HELD IN OR NEAR PROVO, UTAH BEFORE A SINGLE ARBITRATOR.  THE ARBITRATOR SHALL BE SELECTED BY MUTUAL AGREEMENT OF THE PARTIES OR, IF THE PARTIES CANNOT AGREE, BY SELECTING AN ARBITRATOR FROM A LIST OF ARBITRATORS SUPPLIED BY THE AMERICAN ARBITRATION ASSOCIATION. THE ARBITRATION SHALL BE A CONFIDENTIAL PROCEEDING, CLOSED TO THE GENERAL PUBLIC. THE ARBITRATOR SHALL ISSUE A WRITTEN OPINION STATING THE ESSENTIAL FINDINGS AND CONCLUSIONS UPON WHICH THE ARBITRATOR’S AWARD IS BASED. THE PARTIES WILL SHARE EQUALLY IN PAYMENT OF THE ARBITRATOR’S FEES AND ARBITRATION EXPENSES AND ANY OTHER COSTS UNIQUE TO THE ARBITRATION HEARING (RECOGNIZING THAT EACH SIDE BEARS ITS OWN DEPOSITION, WITNESS, EXPERT AND ATTORNEYS’ FEES, AND OTHER EXPENSES TO THE SAME EXTENT AS IF THE MATTER WERE BEING HEARD IN COURT). NOTWITHSTANDING THE FOREGOING, THE ARBITRATOR MAY REQUIRE THAT SUCH FEES BE BORNE IN A MANNER AS THE ARBITRATOR DETERMINES IS REQUIRED IN ORDER FOR THIS ARBITRATION CLAUSE TO BE ENFORCEABLE UNDER  LAW.

    THE INTERNAL SUBSTANTIVE LAWS (AS DISTINGUISHED FROM THE CHOICE OF LAW RULES) OF THE STATE OF UTAH AND THE UNITED STATES OF AMERICA APPLICABLE TO CONTRACTS MADE AND PERFORMED ENTIRELY IN UTAH SHALL GOVERN THE VALIDITY AND INTERPRETATION OF THESE OFFICIAL RULES AND ALL OTHER CAUSES OF ACTION (WHETHER SOUNDING IN CONTRACT OR IN TORT) ARISING OUT OF OR RELATING TO THE CONTEST OR THESE OFFICIAL RULES.
  13. Rules/Winner Information: For a copy of these Official Rules, send a self-addressed, stamped envelope to: Provo Craft Cricut Ticket Contest Official Rules, Provo Craft & Novelty, Inc., 151 East 3450 North, Spanish Fork, Utah 84660. These Official Rules will also be available on the Provo Craft Website at www.provocraft.com during the entire Contest.
